Please read these Terms of Service ("Terms") carefully before using the Skinship Aesthetics website, purchasing any products, or receiving any in-office treatments. By accessing our website, making a purchase, or scheduling an appointment, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

2. Acceptance of Terms

By using our website (the "Site"), placing an order, or receiving in-office services, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be legally bound by them. If you are under 18, you may only use our services with the consent and involvement of a parent or legal guardian.

3. Products and Services

3.1 Online Sales

We offer skincare and aesthetic products for purchase through our website. All product descriptions, images, and pricing are subject to change without notice. We reserve the right to limit quantities, refuse service, or cancel orders at our discretion. Products purchased online are subject to our Shipping and Returns policies described in these Terms.

3.2 In-Store Sales

Products are also available for purchase at our physical retail location during business hours. In-store pricing may vary from online pricing. All in-store sales are final unless otherwise stated at the time of purchase or as required by applicable law.

3.3 In-Office Treatments

Skinship Aesthetics offers a range of aesthetic and cosmetic treatments including, but not limited to, injectables, facials, laser treatments, body contouring, and other medspa services. All treatments are performed by or under the supervision of licensed medical or aesthetic professionals. Availability of specific treatments is subject to change.

4. Orders and Payment

4.1 Order Acceptance

Placing an order online or in-store does not constitute a binding contract until we confirm acceptance of your order. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, pricing errors, or product unavailability. You will be notified promptly if your order is cancelled and any charges will be refunded.

4.2 Pricing

All prices are listed in U.S. dollars and are subject to change without notice. Applicable taxes will be added at checkout. We make every effort to display accurate pricing, but in the event of a pricing error, we reserve the right to cancel the order and notify you of the correct price.

4.3 Payment Methods

We accept major credit and debit cards, and any other payment methods listed at checkout or at our physical location. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge the applicable amount.

4.4 Treatment Deposits

Certain in-office treatments may require a non-refundable deposit at the time of booking to reserve your appointment slot. Deposit amounts will be communicated at the time of scheduling. Deposits are applied toward the total cost of the treatment.

5. Appointment and Cancellation Policy

5.1 Scheduling

In-office treatments must be scheduled in advance through our Boulevard booking platform or by contacting us directly. We recommend booking ahead as availability may be limited. This policy is disclosed to you, the cardholder, in compliance with Card Brand requirements and applies to all appointments booked through the Boulevard platform. By booking an appointment, you acknowledge your understanding of and agreement to the terms below.

5.2 Cancellations

You may cancel your appointment without a cancellation fee if you do so at least 24 hours before your scheduled appointment start time. Cancellations made with less than 24 hours' notice are considered a "Late Cancellation" and are subject to a fee of $40. Applicable taxes and fees will be retained and remitted.

5.3 Appointment Reminders and Confirmations

As a courtesy, appointment confirmation messages are sent 48 hours in advance by email and 24 hours in advance by SMS to the contact information provided at the time of booking. Failing to respond to those confirmation messages could result in your appointment slot being offered to another client.

5.4 Arrival

To ensure a full treatment experience, please arrive at least 10 minutes before your scheduled appointment time. Late arrivals may result in a shortened treatment duration, and the full service fee may still apply.

6. Health, Safety, and Medical Disclaimer

6.1 Medical Consultation

Prior to receiving any in-office treatment, you will be required to complete a health intake form and, where appropriate, undergo a consultation with a licensed professional. It is your responsibility to provide complete and accurate health information. Failure to disclose relevant medical history may result in adverse outcomes for which Skinship Aesthetics assumes no liability.

6.2 Not a Substitute for Medical Advice

The services, products, and information provided by Skinship Aesthetics are for aesthetic and wellness purposes only. Nothing on our Site or in our communications constitutes medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider regarding any medical conditions.

6.3 Treatment Risks

All aesthetic treatments carry inherent risks, which will be explained during your consultation. By proceeding with a treatment, you acknowledge that you have been informed of and accept the associated risks, and you agree to follow all pre- and post-treatment care instructions provided by our staff.

6.4 Contraindications

Certain treatments are not appropriate for individuals with specific medical conditions, allergies, or who are pregnant or breastfeeding. It is your responsibility to inform us of any conditions that may be relevant. We reserve the right to decline treatment if we determine it is not safe or appropriate for you.

6.5 Informed Consent

Before receiving any in-office treatment, you will be asked to sign a separate informed consent form specific to that procedure. Signing the consent form is required before any treatment may be administered.

7. Returns and Refunds

7.1 Online Product Returns

Unused, unopened products may be returned within 14 days of delivery for a full refund. To initiate a return, please contact our Customer Support team at hello@skinshipaesthetics.com with your order number and reason for return. Return shipping costs are the responsibility of the customer unless the return is due to our error or a defective product.

7.2 In-Store Product Returns

In-store product purchases may be exchanged or returned for store credit within 14 days of purchase with a valid receipt, provided the product is unused and in its original condition. We do not offer cash refunds on in-store purchases unless required by applicable law.

7.3 Treatment Refunds

All sales of in-office treatments are final once a treatment has been rendered. If you are dissatisfied with your results, please contact us within 7 days of your appointment and we will work with you to address your concerns. Pre-purchased treatment packages are non-refundable but may be transferred to another individual or applied to alternative services at our discretion.

7.4 Non-Returnable Items

For health and hygiene reasons, the following items are non-returnable: opened skincare products, items marked as final sale, and any products used or partially used.

8. Shipping and Delivery

We ship products to addresses within the United States. Estimated shipping times are provided at checkout and are not guaranteed. We are not responsible for shipping delays caused by carriers, weather, or other circumstances beyond our control. Risk of loss and title for products pass to you upon delivery to the carrier. If your order arrives damaged, please contact us within 3 days of delivery so we can assist you.

9. Use of Our Website

9.1 Permitted Use

You may use our Site for lawful purposes only. You agree not to use the Site in any way that violates applicable laws, infringes on the rights of others, or interferes with the operation of the Site or our services.

9.2 Account Registration

If you create an account on our Site, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized access or use of your account.

9.3 Prohibited Conduct

You agree not to: scrape, crawl, or harvest data from our Site; introduce malicious code or viruses; attempt to gain unauthorized access to any portion of the Site; or use the Site for any fraudulent or harmful purpose.

10. Intellectual Property

All content on our Site, including but not limited to text, images, logos, graphics, videos, and treatment descriptions, is the property of Skinship Aesthetics or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content without our prior written consent.

11. Privacy

Your use of our Site and services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy. We take the privacy of your health and personal information seriously and handle it in accordance with applicable law, including HIPAA where applicable.

12. Disclaimer of Warranties and Limitation of Liability

12.1 Disclaimer of Warranties

Our products and services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that our Site will be uninterrupted, error-free, or free of viruses.

12.2 Limitation of Liability

To the fullest extent permitted by law, Skinship Aesthetics and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our products, services, or website. Our total liability to you for any claim arising out of or related to these Terms or our services shall not exceed the amount you paid to us in the 90 days preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Skinship Aesthetics and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of our services, your violation of these Terms, or your violation of any rights of a third party.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the state in which Skinship Aesthetics is located, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or our services shall be resolved through good-faith negotiation. If the parties cannot reach a resolution, disputes shall be submitted to binding arbitration in accordance with applicable arbitration rules, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on our Site with an updated effective date. Your continued use of our services after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

16. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy and any signed consent forms, constitute the entire agreement between you and Skinship Aesthetics regarding the subject matter herein.
